Terms of Use

These Terms of Use govern the use of the YouReply Survey platform (the "Platform") provided by YouReply Teknoloji Ticaret Eğitim Danışmanlık Araştırma Organizasyon A.Ş. ("YouReply"). By creating an account, signing in to the Platform or purchasing a plan, you accept these terms.

1. Definitions

  • Platform: the YouReply Survey online survey software and the subdomains through which it is provided.
  • User: the account holder and the users added to the account.
  • Researcher: a User who creates and publishes surveys on the Platform.
  • Respondent: a person who answers a published survey.
  • User Content: the surveys a User creates, the content they upload and the responses they collect.
  • Usage period: the monthly or annual period that starts when a paid plan is purchased.

2. Account rules

  • You are responsible for the accuracy and currency of the information you provide when creating an account.
  • You must be 18 or over and have legal capacity to open an account.
  • If you open an account on behalf of a legal entity, you are deemed to have declared that you are authorized to represent and bind that entity.
  • Usernames and passwords are personal and may not be shared. You are responsible for actions taken through your account. If you become aware of unauthorized access, notify us without delay.
  • In organization accounts, roles (Owner, Billing, Admin, Member) and product roles are set by the account holder, who is responsible for assigning them correctly.

3. Plans and usage period

The plans on sale:

  • Free: free of charge
  • Academic: monthly or annual usage period; does not renew automatically at the end of the period
  • Individual: monthly or annual usage period; does not renew automatically at the end of the period
  • Team: monthly or annual usage period; does not renew automatically at the end of the period
  • Business: monthly or annual usage period; does not renew automatically at the end of the period
  • Business Plus: monthly or annual usage period; does not renew automatically at the end of the period
  • Enterprise: price, limits and period set by contract

Paid plans are sold per period and are subject to the following rules:

  • Payment is taken once for the selected period (1 month or 1 year).
  • There is no automatic renewal. At the end of the period the product returns to the Free plan by itself; there is nothing to cancel.
  • If you want to continue, you buy again. The new period starts from the moment of purchase; remaining days are not carried over and are not refunded.
  • You cannot move to the Free plan while a paid period is live; you wait for it to end.
  • Current prices, limits and the amount payable are shown on the pricing page and in the order summary.

All conditions relating to the purchase are set out in the Preliminary Information Form and the Distance Sales Agreement. In the event of a conflict, the Distance Sales Agreement prevails on matters relating to the sale and these Terms prevail on matters relating to the use of the Platform.

4. Plan limits define the scope of use

Limits such as the number of active surveys, the response volume and the number of users show the scope of the usage right you have purchased. These limits are not automatically enforced by the software today: the fact that a limit does not stop you by itself does not mean it may be exceeded. If we find that limits are clearly being exceeded, we contact you and ask you to choose the appropriate plan.

Using your own logo, account name and brand colour in surveys is available to organization accounts; this feature does not depend on the plan.

5. Acceptable use

You agree to use the Platform in compliance with the law, morality and the rules of good faith. In particular, you may not:

  • publish content that is unlawful, insulting, threatening or hateful, or that infringes personal rights, the privacy of private life or intellectual property rights;
  • collect personal data without a legal basis for processing, or obtain responses by misleading respondents or concealing the purpose of the survey and the identity of the data controller;
  • send commercial electronic messages without consent, or use the Platform as a vehicle for unsolicited messages;
  • upload malicious software, attempt to circumvent security measures, or attempt unauthorized access or penetration testing;
  • create abnormal load through automated tools or impede the operation of the service;
  • reverse engineer the Platform, attempt to obtain its source code, lease it to third parties or resell it as a service in your own name;
  • artificially influence response counts or generate fictitious responses.

6. The researcher's data responsibility

You are responsible for the content and target audience of your survey and for the data you collect. If you collect personal data, you are the data controller within the meaning of the KVKK, and YouReply is a data processor limited to the provision of the service. Informing respondents, ensuring there is a condition for processing and, where required, obtaining explicit consent are your obligations. The obligations of the parties are set out in the Data Processing Agreement, which is an annex to these Terms. 7. Intellectual property

  • All rights in the software constituting the Platform, its source code, database structure, interface design, trade marks and logos belong to YouReply. Purchasing a plan grants you only the right to use the service within the framework of these Terms; it is not a transfer of ownership or of a licence.
  • Rights in the surveys you create, the content you upload and the responses you collect belong to you. YouReply processes this content solely to provide, maintain and secure the service.
  • You confirm that you hold the rights to use the logos, trade marks and images you upload to your account and that you are responsible for any third-party claims arising from them.

8. Service availability

YouReply uses reasonable efforts to keep the Platform available, but does not warrant that it will operate uninterrupted and error-free and gives no service level (SLA) commitment. Maintenance, updates, outages originating from infrastructure providers and force majeure do not constitute an impediment to performance. Planned maintenance is announced in advance where possible. New features may be added and existing ones changed; changes that materially narrow the scope of the plan you purchased are not applied to your detriment during your current usage period.

9. Limitation of liability

  • YouReply is not responsible for the lawfulness of survey content, the scientific validity of survey results, or the decisions you take in reliance on those results.
  • YouReply's aggregate liability under these Terms is limited to the fees actually paid by you in the twelve-month period preceding the event giving rise to liability.
  • This limitation does not apply to wilful misconduct, gross negligence or liability that cannot be limited under applicable law.
  • Where links to third-party websites are provided through the Platform, YouReply is not responsible for their content.

10. Suspension and termination

Should these Terms, the sales agreement or the applicable legislation be breached, YouReply may, upon notice or without notice where the nature of the breach so requires, suspend the account or the relevant content, restrict access, or terminate the right of use. In such case no refund may be claimed for the remaining period. You may also stop using the Platform or close your account at any time.

11. Data when the account is closed

The account deletion flow, the waiting period, the data that is anonymized afterwards and the records kept under legislation are described on the Account and Data Deletion page. Surveys and responses are not deleted by account deletion; their deletion must be requested separately. You can export your data as Excel (.xlsx) or CSV at any time.

12. Changes

These Terms may be updated due to legislative changes or the development of the service. Material changes are announced before they take effect, via the email address registered in your account or in the account dashboard. Continuing to use the Platform after such an announcement constitutes acceptance of the current Terms. The current version is always published on this page and the last updated date is shown at the top.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Türkiye. Where you qualify as a consumer, the Provincial and District Consumer Arbitration Committees at your place of residence or the place of the transaction are competent up to the monetary limits announced annually by the Ministry of Trade, and the Consumer Courts above those limits. Where consumer status does not apply, the courts and enforcement offices of Ankara are competent.

14. Other provisions and contact

If any provision of these Terms is held invalid, this does not affect the validity of the remaining provisions. YouReply's failure to exercise its rights does not constitute a waiver of them.
